The Clerk of Courts office is open Monday through Friday, 8:00 a.m. to 5:00 p.m. The Probate Court accepts walk-ins from 8:00 a.m. to 4:00 p.m., with appointments available until 3:30 p.m. The Magistrate Court staff is available 8:00 a.m. to 5:00 p.m. on regular business days.

Are Court Records Public in Bulloch County?

Georgia law creates a strong presumption of openness for court records. The Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.) declares that public records shall be open for personal inspection and copying. In addition, Rule 21 of the Uniform Rules of the Superior Courts states that all court records are public and available for inspection unless access is limited by law or by a specific court procedure.

Despite this broad openness, certain categories of records are restricted or exempt from public disclosure:

Bulloch County Criminal Court Records

Criminal cases in Bulloch County are divided between two trial courts. Felonies and serious offenses are prosecuted in the Superior Court, while misdemeanors (punishable by up to 12 months in jail and a fine of up to $1,000, or $5,000 for aggravated misdemeanors) and traffic offenses in unincorporated areas are handled by the State Court of Bulloch County. For statewide criminal history maintained by the Georgia Crime Information Center (GCIC), disclosure and dissemination are governed by O.C.G.A. § 35-3-34. The Georgia Bureau of Investigation processes fingerprint-based background checks for employment and licensing purposes, and records restriction is available under O.C.G.A. § 35-3-37 with prosecutorial approval.

Criminal Filing Fees

The cost schedule effective July 1, 2025, applies the general civil filing rate of $218 to criminal appeals transferred from lower courts. Sheriff’s service fees for criminal matters include $50 per copy served, $20 for taking bonds, and $20 for search and return of nulla bona.

Bulloch County Civil Court Records

Property Records

Bulloch County Family Court Records

Family law matters in Bulloch County are handled primarily through the Superior Court (divorce, custody, child support, adoption) and the Probate Court (marriage licenses, guardianships). The State Court does not have domestic relations jurisdiction, and the Magistrate Court cannot hear divorce cases.

Divorce Records

Divorce cases must be filed with the Clerk of the Superior Court in the county where one spouse has resided for at least six months. The current filing fee for a divorce action is $218 (classified under general civil actions effective July 1, 2025). Self-represented litigants can find standard divorce forms on the Judicial Council of Georgia’s website or through the Clerk of Courts’ forms page. An Affidavit of Indigence may be filed to request a fee waiver for those unable to afford the cost.

Certified copies of divorce decrees cost $2.50 for the first page and $0.50 for each additional page. In-person requests require a valid photo ID.

Marriage Records

Marriage licenses are issued by the Bulloch County Probate Court by appointment only. Applications must be submitted online through georgiaprobaterecords.com, after which applicants call (912) 489-8749 to schedule an appointment (accepted 8:00 a.m. to 3:30 p.m.).

Both parties must be at least 18 years old (a 17-year-old may qualify only with a certified juvenile-court emancipation order, a 15-day waiting period, an age-gap limitation, and completion of premarital education). Georgia no longer permits marriage for anyone under 17 or parental consent in lieu of age requirements. Applicants must present valid photo identification and, if applicable, a certified divorce decree or death certificate from a prior marriage.

Birth and Death Records

The Bulloch County Health Department issues certified birth and death certificates for events recorded in the county. Vital records are restricted documents available only to eligible individuals (the registrant, immediate family members, or persons with a legitimate legal interest). Photo ID is required.

Bulloch County Probate Court Records

The Bulloch County Probate Court, presided over by Judge Lorna Deloach, handles the administration of decedent estates, probate of wills, appointment of guardians and conservators, involuntary commitment hearings, land-line disputes, and certain probable-cause hearings. The court is located on the first floor of the courthouse at 2 North Main Street in Statesboro.

Types of Probate Matters

The court’s jurisdiction covers several distinct proceedings, each with its own filing requirements:

  • Estate administration: When a Georgia resident dies, petitions for probate (testate estates) or administration (intestate estates) are filed in the county of the decedent’s residence. Standard forms are available through the Council of Probate Judges via the Judicial Council of Georgia website.
  • Guardianships of minors: The Probate Court may appoint temporary or permanent guardians for minors who have no living parents or whose parents consent or fail to properly provide care. Temporary guardianship does not terminate parental rights and grants the guardian authority to consent to medical treatment and school enrollment.
  • Adult guardianships and conservatorships: For adults incapacitated by physical or mental illness, the court appoints guardians (who make personal-care decisions) and conservators (who manage income and property). Conservators must be bonded and file annual financial accountings, which the court may audit.
  • Minor conservatorships: When a minor inherits money, receives a personal-injury award, or is the beneficiary of life insurance or retirement benefits, a conservator may be appointed to manage those assets under court supervision.
