Understanding which office holds the record you need, and how that office processes requests, is the first step toward a successful search.

How to Look Up a Court Case in Fulton County?

Open Records Requests

Members of the public may also submit a formal request through the Fulton County Open Records Center, which routes inquiries to the appropriate county department. Under O.C.G.A. § 50-18-71, agencies must respond within three business days of receiving a request.

Are Court Records Public in Fulton County?

Georgia operates under a strong presumption of public access to government records. The Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.) declares that all public records — documents, data, photographs, and computer-generated information created, received, or maintained by a government agency — shall be open for personal inspection and copying. Court records filed in Fulton County courts fall squarely within this definition.

However, certain categories are exempt from public disclosure by statute or court order. Records that may be restricted in Fulton County include:

  • Juvenile proceedings — Records involving minors are generally confidential under Georgia law.
  • Sealed first-offender cases — Completed first-offender dispositions may be sealed and retroactively restricted from public view.
  • Certain misdemeanor convictions — Convictions for individuals under 21 at the time of the offense may qualify for restriction.
  • Arrest records where charges were dismissed or resulted in acquittal — Eligible individuals may petition for record restriction.
  • Specific non-violent felony convictions — Depending on the offense and the defendant’s criminal history, some records may qualify for restriction.
  • Records sealed by court order — A judge may order records sealed in specific cases for cause.

Individuals who believe they are eligible for record restriction may submit a Record Restriction Request Form to the Fulton County District Attorney’s Office.

When fulfilling open-records requests, county agencies may charge for copying at $0.10 per page and may assess administrative costs for search and retrieval time if the process exceeds fifteen minutes. These charges are governed by O.C.G.A. § 50-18-71©. The first ten pages and the first fifteen minutes of staff time are generally provided at no charge for Sheriff’s Office requests.

Fulton County Criminal Court Records

Criminal matters in Fulton County are divided between the Superior Court, which has jurisdiction over felonies and cases requiring a jury trial, and the State Court, which handles misdemeanors and certain traffic offenses. The Clerk of Superior and Magistrate Courts maintains the official criminal case files for Superior Court matters, while the State Court Clerk maintains misdemeanor records.

Searching Criminal Court Records Online

The Clerk’s eServices platform provides access to criminal case information through the Odyssey portal. To search:

  1. Navigate to the portal and log in (or register for an account).
  2. Select the appropriate court (Superior, State, or Magistrate).
  3. Enter the defendant’s name or case number.
  4. Review results for docket entries, hearing dates, charges, and disposition.

The eFileGA system also allows registered users to search criminal filings. After creating an account, use the Case Search function, enter the court location and case number or party name, and select from the results.

In-Person Criminal Records

Criminal case files can be inspected at the downtown courthouse. An individual criminal record search through the Clerk’s office costs $2.00 per search. Certified copies are $2.50 for the first page and $0.50 for each additional page.

Sheriff’s Office Records

Arrest records, booking reports, and incident reports are maintained by the Fulton County Sheriff’s Office, not the court. Requests should be submitted through the Fulton County Open Records Center. The Sheriff’s Office charges $0.10 per page for copies (the first ten pages at no charge) and may assess hourly administrative charges for requests that exceed fifteen minutes of staff time.

State Criminal History

For a comprehensive Georgia criminal history report, contact the Georgia Bureau of Investigation (GBI) Crime Information Center. Personal criminal history requests require fingerprinting and a fee payable to GCIC. Appointments can be made by calling (404) 244-2639 (option 1).

Fulton County Civil Court Records

Civil cases in Fulton County are heard across multiple courts. The Superior Court handles general civil actions exceeding Magistrate Court jurisdictional limits, cases involving equity, and matters such as title disputes and injunctions. The Magistrate Court adjudicates small claims, landlord-tenant disputes, and civil claims within its monetary jurisdiction. The State Court also handles certain civil matters.

Searching Civil Records

Online searches for civil case information are available through the Clerk’s eServices platform. The Civil eFiling portal allows registered users to search for and electronically file civil documents. You may also use the Odyssey portal to search Superior Court and Magistrate Court civil records by party name or case number.

To request copies of civil records, you may:

Real Estate and Property Records

Deeds, liens, and other instruments affecting real property are recorded with the Clerk of Superior Court and searchable through the GSCCCA statewide database. Recording fees for real-estate instruments are $25.00 per filing. Plats, maps, and floor plans cost $10.00 per page to record. The Clerk also offers Real Estate eRecording for electronic submissions.

Fulton County Family Court Records

The Family Division of the Superior Court of Fulton County exercises jurisdiction over divorce, legal separation, annulment, child custody and visitation, child support, paternity, and domestic violence matters. Four Superior Court judges are assigned to the Family Division. The Clerk of Superior and Magistrate Courts maintains family law case files.

Divorce Records

Divorce petitions are filed with the Clerk of Superior Court. The divorce filing process varies depending on whether the divorce is contested, uncontested, or by publication. Each type requires specific forms (petition, case initiation form, standing order, and applicable acknowledgments or affidavits). The filing fee for a divorce action is $223.00.

Family Law Forms

Downloadable family law form packets — covering divorce, child custody, child support, name changes, legitimation, contempt, and other matters — are available at no charge through the Justice Resource Center and the Superior Court’s family law forms page. Packets require Adobe Acrobat Reader.

Marriage Records

Marriage licenses and certificates in Fulton County are issued and maintained by the Fulton County Probate Court, not the Superior Court. To request a marriage certificate:

  1. Complete a Marriage Certificate Request Form.
  2. Submit the form in person at any Probate Court location, or by mail to: Fulton County Probate Court, Attn: Records Division, 136 Pryor St. SW, 2nd Floor C230, Atlanta, GA 30303.
  3. Include a money order payable to Fulton County Probate Court. The fee is $10.00 per certified copy. Searches for marriages before 1979 carry an additional $10.00 research fee.
  4. Mail requests must include a self-addressed stamped envelope.

The Probate Court does not accept personal checks. In-person payments may be made by credit card (no American Express), debit card, cash, money order, or cashier’s check.

Birth and Death Records

Walk-in fee: $25.00 (non-refundable search fee, includes one certified copy if found). Additional copies of the same record ordered at the same time cost $5.00 each. Georgia law requires prepayment. Accepted payment methods include cash, certified check, money order, and Visa or MasterCard debit/credit cards (no American Express).

Certificates can also be ordered online through VitalChek or by mail. The Georgia Department of Public Health issues certificates for events statewide at its main office at 47 Trinity Ave. SW, Atlanta, GA 30334, with a fee of $25.00 per certified copy plus $8.00 processing.

Fulton County Probate Court Records

The Fulton County Probate Court has exclusive jurisdiction over the probate of wills, administration of decedents’ estates, appointment and removal of executors and administrators, guardianship and conservatorship of minors and adults, and related matters such as audits of fiduciary returns. The court also handles issuance of marriage licenses and weapons carry licenses.

Searching Probate Records

The Probate Court participates in the re:SearchGA portal, which allows registered users to search court case information online. Estate searches can also be conducted in person at the downtown location or by mail.

Requesting Estate Record Copies

To obtain copies of estate documents (wills, letters testamentary, inventories, accountings, or other filings):

  1. Complete an Estates Record Request Form.
  2. If you are unsure of page counts, email the decedent’s name, year of death or estate number, and the specific documents you need to Probate.Records@fultoncountyga.gov.
  3. Include a money order or cashier’s check payable to Fulton County Probate Court and a self-addressed stamped envelope.

Guardianship and Conservatorship Records

Due to confidentiality requirements, records related to adult guardianship/conservatorship and minor guardianship cannot be requested by mail or online. These requests must be made in person at the downtown Probate Court location.
