Are Court Records Public in Lowndes County?
The Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.) establishes that most government records, including court documents, are open for public inspection and copying. This right of access applies broadly to records maintained by courts, law enforcement agencies, and other county offices in Lowndes County.
Under this framework, civil complaints, criminal indictments, motions, trial transcripts, court orders, judgments, and docket sheets are generally available for review by any member of the public. The Clerk of Superior Court serves as the primary custodian of records for cases filed in the Superior Court and the State Court, while the Magistrate Court and Probate Court maintain their own case files.
Records That Are Restricted or Confidential
Despite the broad presumption of openness, several categories of records are exempt from public disclosure under Georgia law:
- Juvenile proceedings — Records involving minors in the Juvenile Court are generally sealed from public view under O.C.G.A. § 15-11-700 and related provisions.
- Adoption records — Finalized adoption files are confidential and require a court order for access.
- Records sealed by court order — A judge may seal particular case files when privacy, safety, or other compelling interests warrant it.
- Grand jury proceedings — Deliberations and testimony before a grand jury are kept secret.
- Certain victim information — Identifying details of victims in sexual assault and other sensitive cases may be redacted.
- Ongoing criminal investigations — Law enforcement records connected to active investigations may be withheld.
When a record contains a mix of public and confidential material, the custodian is required to redact the exempt portions and release the remainder. Requests that are denied must include a citation to the specific statutory exemption relied upon.
