Are Court Records Public in Muscogee County?
Court records in Muscogee County are presumptively public. Two overlapping legal frameworks govern access: the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.) and Uniform Superior Court Rule 21.

Uniform Superior Court Rule 21 specifically addresses court files. It states that all court records are public and available for inspection unless a court order limits access. A judge may restrict access to a court file only after a hearing and a written finding that the harm from public access clearly outweighs the public interest in open records. Even when access is restricted, the order sealing a file must itself remain public, and it must identify the specific records affected and the duration of the restriction.

Muscogee County Civil Court Records

The general civil filing fee of $218.00 includes the law library fee (up to $5.00) and alternative dispute resolution fees (up to $10.00), plus applicable service fees. Marriage Records
Marriage licenses in Muscogee County are issued by the Muscogee County Probate Court. Both applicants must be present and at least 18 years old. The license fee is $56.00, or $16.00 if the couple provides proof of completing at least six hours of premarital counseling (per O.C.G.A. § 19-3-30.1). Divorce Records
Divorce decrees and related dissolution-of-marriage filings are maintained by the Clerk of Superior and State Courts. Requesters need the full names of the parties, the approximate date of the divorce, and ideally the case number. Copies can be obtained online through the eCourt Portal, in person at the Clerk’s second-floor office, or by mail.
Birth and Death Records
The West Central Health District’s Vital Records Office issues certified copies of birth and death certificates for events recorded in Muscogee County and throughout Georgia. The fee is $25.00 for the first certified copy and $5.00 for each additional copy of the same record ordered at the same time. Payment may be made by debit or credit card, money order, or cashier’s check. Personal checks are not accepted.
Under O.C.G.A. § 31-10-25, access to vital records is restricted to eligible individuals including the person named on the certificate, a parent or grandparent listed on or provably related through the certificate, a natural sibling, a legal spouse, or a legal guardian with a court order. A current photo ID is required.

Muscogee County Probate Court Records
The Muscogee County Probate Court exercises exclusive original jurisdiction over the probate of wills, administration of estates, and appointment of guardians for minors and incapacitated adults. Estate Filing Fees
The Probate Court charges the following base court costs for estate proceedings, with additional fees potentially due for legal notices, service of process, and certified copies:

Required documents for a petition to probate a will include the original will, a death certificate, and the completed petition form. For administration without a will, the petitioner must file a petition for letters of administration along with the death certificate.
Other Probate Matters
The Probate Court administers guardianship appointments for both minors and adults, which may involve a hearing and the posting of a bond. Conservatorship matters, involuntary commitment petitions, and year’s-support proceedings are also within the court’s jurisdiction. Name-change petitions are filed and heard in the Probate Court, as are petitions to correct birth certificates and other vital records.
All probate filings are administered in the county where the decedent was domiciled at death, or in the county of residence for living individuals seeking guardianship, name changes, or other non-estate matters.
