Walker County occupies the northwest corner of Georgia, bordering Tennessee and Alabama, with its county seat in the city of LaFayette. The county’s judicial system operates through several distinct courts, each responsible for different categories of legal matters. The Lookout Mountain Judicial Circuit, which encompasses Walker County along with Catoosa, Chattooga, and Dade counties, administers the Superior Court and State Court. Locally, Walker County maintains a Magistrate Court, a Probate Court, and a Juvenile Court, all headquartered in or near the Walker County Courthouse complex on South Duke Street in LaFayette. The Clerk of Superior Court serves as the primary custodian of civil and criminal case records at the circuit court level, while the Probate Court maintains marriage records, estate files, and guardianship proceedings independently.

Georgia residents and members of the public can search for Walker County court records through several channels. The Georgia Courts website, accessible at GeorgiaStateCourts.us, offers links to the statewide E-Access Court Records system, courthouse directories, and judicial branch forms. At the county level, the Clerk of Superior Court operates an online docket search tool, and physical records are available for inspection at the courthouse during business hours. The Walker County government website and individual court offices publish contact information and procedural guidance for requesting records. Public-access terminals may be available at the courthouse, and several court divisions accept in-person requests for copies of filings, judgments, and other documents.

Open Records Requests

Walker County accepts formal open records requests through its online portal. Pursuant to O.C.G.A. § 50-18-71, requestors may be charged for copying fees (generally $0.10 per page) and staff time for the lowest-paid qualified employee after the first 15 minutes.

Are Court Records Public in Walker County?

Georgia law strongly favors public access to court records. Under Uniform Superior Court Rule 21, all court records are presumed public and must be available for inspection unless access is restricted by law or by a court order entered after specific findings. The Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.) reinforces this principle by granting any person the right to inspect and copy public records maintained by government agencies, including courts.

How Rule 21 Works

Under Rule 21, a court may limit access to specific records only upon a motion by a party, a finding that the harm caused by disclosure clearly outweighs the public interest, and the entry of a written order specifying the reasons for the restriction. Blanket sealing of entire case files is not permitted absent extraordinary circumstances. Ex parte orders restricting access are limited to emergencies and must be reviewed within a set timeframe.

Records That Are Typically Restricted

Despite the general presumption of openness, certain categories of Walker County court records are exempt from public disclosure:

  • Medical records submitted as part of court proceedings
  • Juvenile court records involving minors
  • Adoption records and related confidential filings
  • Attorney-client privileged communications contained in court files
  • Confidential attorney work product
  • Records related to pending criminal investigations or prosecutions
  • Weapons carry license records maintained by the Probate Court
  • Personal identifiers including Social Security numbers, dates of birth, bank account numbers, credit card information, and utility account numbers contained in filings
  • Jury list data including names, addresses, and demographic information of prospective jurors

Individuals seeking access to records that may fall into a restricted category should contact the relevant court office to determine whether a formal motion or court order is required.
