- Determine the case type. Felonies and general civil matters (including divorce) fall under the Superior Court. Are Court Records Public in Walton County?
Georgia law establishes a strong presumption of public access to government records, including court documents. Under the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.), members of the public may inspect and obtain copies of records maintained by government agencies and courts. Custodians of records are required to make them available within a reasonable time after receiving a request, and requesters are not required to state a reason for seeking access.

Access is generally limited to the record subject, authorized employers conducting background checks, and criminal justice agencies. Walton County Civil Court Records
Civil matters in Walton County are divided between the Superior Court and the Magistrate Court based on the nature and dollar amount of the case.
The Superior Court has jurisdiction over general civil cases with unlimited monetary claims, civil equity matters, and real estate title and boundary disputes. The Civil Division of the Clerk of the Superior Court is responsible for filing, processing, storing, and retrieving all civil records for the Superior Court. This division also manages appeal records and prepares executions for filing in the General Execution and Lien Docket.

The courts charge fees for printing requested documents. Fees changed effective July 1, 2024, pursuant to House Bill 322; a list of updated fee changes is available from the Clerk’s office.

Walton County Family Court Records
Family law cases in Walton County—including divorce, child custody, child support, and domestic relations matters—are heard exclusively in the Superior Court. Georgia’s Superior Courts hold exclusive original jurisdiction over divorce proceedings, and all family-related case records are maintained by the Clerk of the Superior Court’s Civil Division.

Divorce decrees, settlement agreements, custody orders, and related filings can be obtained from the Clerk of Superior Court. Marriage licenses and certificates:
The Walton County Probate Court issues marriage licenses and maintains marriage records. Applicants must first complete an online application at Georgia Probate Records to receive a confirmation number, then schedule an appointment with the court. No marriage applications are accepted after 4:00 p.m.

- Marriage license without premarital education: $66 (includes one certified marriage certificate)
- Marriage license with premarital education: $26 (includes one certified marriage certificate; requires a completed Pre-Marital Counseling Form)
- Additional marriage certificates: $10 each
- Payment: Exact cash, money order, cashier’s check, Visa, or Mastercard (convenience fee applies to card payments; no personal checks accepted)
Copies of marriage certificates can also be requested online through the Fee Pay Online portal for $10 per certificate plus a convenience fee. It is recommended to verify the marriage record exists at Georgia Probate Records or by calling (770) 267-1345 before placing an order, as the certificate fee is nonrefundable.
The Georgia Department of Public Health – State Office of Vital Records also maintains marriage certificates issued between June 1952 and August 1996 and can verify marriage events occurring after January 1, 2024. To request records from the state, applicants must complete a marriage certificate request form or verification form, attach a copy of a government-issued ID, and enclose a $10 search fee plus $5 for each additional copy. Birth and death records are not court records in Georgia. They are maintained by the Georgia Department of Public Health. Copies of birth and death certificates can be obtained through the Walton County Health Department Vital Records office at 1404 South Madison Avenue, Monroe, GA 30655. The fee is $25 per certificate. Requesters must provide a completed request form, a copy of a photo ID, and payment. Birth certificates are only available to the named individual, their parents or guardians, and close family members.
Walton County Probate Court Records
The Walton County Probate Court exercises exclusive original jurisdiction over the probate of wills, administration of estates, appointment of guardians and conservators for both minors and adults, and involuntary hospitalization proceedings. The court also hears certain misdemeanor and traffic cases (in the absence of a state court in the county), issues marriage and firearms licenses, and administers oaths of office.

Probate filings in Walton County include petitions for probate of wills, petitions for letters of administration, estate inventories and accountings, fiduciary compliance reports, guardianship petitions and annual reports, conservatorship filings, and involuntary treatment petitions. Additional fees may apply, including an Indigent Defense fee of $15 on certain initial petitions, ADR fees, Children’s Trust Fund fees, and Law Library fees as required by Georgia statute. Recording fees are no longer assessed. The Probate Court accepts Visa and Mastercard for most services (convenience fee applies), as well as exact cash and money orders.
Traffic court matters handled by the Probate Court can often be resolved without appearing in person. Fines may be paid at the court window, online through EZ Court Pay, or by phone at (800) 262-0128. However, certain serious offenses—including DUI, driving on a suspended license, reckless driving, no insurance, and speeding more than 24 mph over the limit for drivers under 21—require a court appearance.
