    How to Look Up a Court Case in Washington County?

    Before you contact any office, identify the relevant court. The Washington County Clerk of Court — currently Megan Cramer — is the central record-keeper for Superior Court and State Court cases. The Probate Court and Magistrate Court each maintain their own separate records.     There are three main ways to access Washington County court records:

    • Online: The Georgia Superior Court Clerk's Cooperative Authority eCertification Portal lets you request digital certified copies of court records and real estate documents from participating Georgia counties, including Washington County. You'll need an account to place requests and download documents.
    • In person: Visit the relevant court clerk's office during business hours. Bring identifying information about the case — the party's name, case number, or approximate filing date. Staff can help locate records but cannot provide legal advice.
    • By mail: Send a written request to the appropriate clerk's office. Include the case name, case number, a description of the documents you need, and payment for any copy fees.

    For civil cases filed by attorneys since January 1, 2019, Georgia law requires electronic filing through PeachCourt, the state’s official civil e-filing platform for Superior and State Court matters.

    Are Court Records Public in Washington County?

    Washington County court records are generally open to the public. The Georgia Open Records Act (O.C.G.A. §§ 50-18-70 through 50-18-74) establishes a broad right of public access to government records, and Georgia courts maintain a parallel common-law tradition of open court records. That said, neither framework grants unconditional access — specific categories of records are withheld by statute or by judicial order.

    Records restricted from public access in Washington County include:

    Washington County Criminal Court Records

    Criminal cases in Washington County are divided between two courts depending on the severity of the charge. The Washington County Superior Court handles all felony criminal prosecutions — including death penalty cases — with the support of the District Attorney’s Office and the Public Defender. The State Court of Washington County, presided over by Judge John A. Dana, handles all misdemeanor criminal cases and traffic violations. Arrest warrants, bond hearings, and preliminary hearings fall under Magistrate Court jurisdiction.

    Washington County Civil Court Records

    For Sheriff’s service of process in Superior or State Court filings, there is an additional $50.00 fee. Self-represented parties may pay civil filing fees in cash, money order, or credit/debit card — note that a 5% transaction fee applies to card payments for State Court, and a $10 minimum applies for credit/debit copy fees in Superior Court. The Magistrate Court generally holds civil hearings on Mondays and Wednesdays, with morning sessions at 10:00 a.m. and afternoon sessions at 2:00 p.m.

    Washington County Family Court Records

    Family law matters in Washington County — including divorce, child custody, child support, adoption, name changes, parental rights, family violence protective orders, and stalking protective orders — fall under the exclusive jurisdiction of the Washington County Superior Court. All such cases are filed with, and maintained by, the Clerk of Superior Court.

    Divorce decrees and the full divorce case file are public records accessible through the clerk’s office or via the eCertification portal. Certified copies follow the standard Superior Court fee schedule: $2.50 for the first page and $0.50 per additional page. Access to certified divorce case documents is restricted to parties to the proceeding, their legal representatives, and other authorized individuals.

    Marriage records are issued and maintained by the Washington County Probate Court (Judge Russell Sheppard). The Probate Court is the official issuer of marriage licenses in the county and holds marriage records from 1952 to the present.

    Marriage records from before 1952 are not held by the Probate Court. If you’re researching earlier Washington County marriages, consult the Georgia Archives, which holds marriage records on microfilm, or the FamilySearch catalog, which indexes Washington County marriages dating back to 1828.

    Birth and death records are maintained by the Georgia Department of Public Health’s Office of Vital Records rather than by local county courts. Birth records are restricted for 100 years from the date of birth, and death records are restricted for 75 years from the date of death. Eligible individuals may request certified copies by submitting a completed Georgia Birth Certificate Application or Georgia Death Certificate Application to either the state office or the Washington County Health Department. Certified copies may also be ordered online through the Georgia DPH’s ROVER portal at a fee of $25 per copy plus an $8 processing fee.

    Washington County Probate Court Records

    The Washington County Probate Court, under Judge Russell Sheppard, handles a broad range of proceedings beyond estate administration. The full scope of matters heard by the court includes:

    All probate records — including estate filings, guardianship records, and mental health commitment orders — are maintained by the Probate Court Clerk’s office at 129 West Haynes Street, Room 106, Sandersville, GA 31082. Most estate and will records are open to public inspection; however, mental health commitment records and certain guardianship files carry confidentiality protections under Georgia law.
